1. Acceptance of These Terms

 

These Terms of Use (“Terms”) govern your access to and use of the website located at abckidsny.com and any related pages, forms, accounts, portals, and online resources (collectively, the “Site”) operated by Ability Builders for Children, LLC (“Ability Builders,” “we,” “us,” or “our”).

By accessing or using the Site, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated here by reference. If you do not agree to these Terms, please do not use the Site.

2. Eligibility and Authorized Users

 

The Site is intended for use by adults — including parents, legal guardians, caregivers, service coordinators, therapists, and partner organizations. It is not directed to children, and children should not use the Site or submit information through it without the involvement of a parent or guardian.

 

By using the Site, you represent that you are at least 18 years old (or the age of majority in your jurisdiction) and that any information you submit is accurate and that you are authorized to provide it, including any information about a child for whom you are a parent, guardian, or authorized representative.

3. The Site and Our Services

 

The Site provides information about Ability Builders and the Early Intervention (EI) and related developmental services we offer, and it allows visitors to contact us, submit referrals and service inquiries, sign up for newsletters or updates, and access certain resources. We may add, change, suspend, or discontinue any part of the Site at any time without notice.

No provider-client or treatment relationship is created simply by using the Site, submitting a form, or contacting us through it. A service relationship begins only through our formal intake, eligibility, authorization, and consent processes.

4. Accounts and Portal Access

 

Some areas of the Site may require an account or portal login. If you create or are issued account credentials, you agree to:

  • Provide accurate and complete registration information and keep it current;

  • Keep your username and password confidential and not share them;

  • Be responsible for all activity that occurs under your account; and

  • Notify us promptly of any unauthorized use of your account or any other security concern.

 

We may suspend or terminate your account at our discretion, including if we believe these Terms have been violated or that account security has been compromised. Access to records or documents through any portal is also subject to our HIPAA Notice of Privacy Practices and applicable consents.

5. Acceptable Use

 

You agree to use the Site only for lawful purposes and in accordance with these Terms. You agree not to:

  • Use the Site in any way that violates applicable law or regulation;

  • Submit false, misleading, or unauthorized information, or impersonate any person or entity;

  • Upload or transmit viruses, malware, or any code designed to disrupt or damage the Site or others’ systems;

  • Attempt to gain unauthorized access to the Site, accounts, servers, or networks, or to other users’ information;

  • Interfere with or disrupt the integrity or performance of the Site;

  • Scrape, harvest, or collect information about other users; or

  • Use the Site to send unsolicited communications or for any harassing, abusive, or harmful purpose

When you submit a contact request, referral, service inquiry, or other communication through the Site, you agree that the information you provide is accurate and that you have the right to share it. We will handle information you submit in accordance with our Privacy Policy and, where applicable, HIPAA.

 

Do not transmit sensitive health information through unsecured forms or email. Standard website forms and ordinary email are not secure. Please share only the minimum information needed to begin a conversation; we will follow up using a secure method when appropriate.

If you sign up for our newsletter or updates, you consent to receive those communications and may unsubscribe at any time using the link in the email or by contacting us. The Site and its content — including text, graphics, logos, images, designs, and the “Ability Builders for Children” name and branding — are owned by or licensed to Ability Builders and are protected by intellectual property laws. Except as expressly permitted, you may not copy, reproduce, distribute, modify, publicly display, or create derivative works from the Site or its content without our prior written permission.

 

You may view and print materials from the Site for your own personal, non-commercial, informational use, provided you do not remove any copyright or proprietary notices.

TO THE FULLEST EXTENT PERMITTED BY LAW, Ability Builders and its members, managers, employees, contractors, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, goodwill, or other intangible losses, arising out of or relating to your access to or use of (or inability to use) the Site, even if advised of the possibility of such damages.

To the extent any liability cannot be excluded, our total aggregate liability arising out of or relating to the Site will not exceed $100. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you. Nothing in these Terms limits liability that cannot be limited under applicable law.

13. Indemnification

 

You agree to indemnify, defend, and hold harmless Ability Builders and its members, managers, employees, contractors, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Site, your violation of these Terms, or your violation of any rights of a third party.

14. Governing Law and Dispute Resolution

 

These Terms are governed by the laws of the State of New York, without regard to its conflict-of-laws principles. You agree that any dispute arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in Bronx County, New York, and you consent to the personal jurisdiction of those courts.

15. Changes to These Terms

 

We may revise these Terms from time to time. When we do, we will update the “Last Updated” date above and post the revised Terms on the Site. Material changes may be communicated through additional notice where appropriate. Your continued use of the Site after the changes take effect constitutes acceptance of the revised Terms.

16. Miscellaneous

  • Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and Ability Builders regarding the Site.

  • Severability. If any provision is found unenforceable, the remaining provisions will remain in full force and effect.

  • No waiver. Our failure to enforce any provision is not a waiver of our right to do so later.

  • Assignment. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
