Ability Builders for Children, LLC (“Ability Builders,” “we,” “us,” or “our”) is committed to protecting the privacy of the families, children, providers, and visitors who use our website at abckidsny.com (the “Site”). This Privacy Policy explains what information we collect through the Site, how we use and protect it, and the choices you have.

 

Because we provide Early Intervention (EI) and related developmental services for children, we recognize that the information families share with us is sensitive. We take that responsibility seriously. By using the Site, you agree to the practices described in this Privacy Policy.

 

Important: This Privacy Policy applies to information collected through our website. It does not replace any separate notices we provide about your clinical records, including our Notice of Privacy Practices under HIPAA, which governs the protected health information we maintain as part of providing services.

We collect information in the following ways:

2.1 Information You Provide Directly

 

When you fill out a contact form, referral form, or service-inquiry form, or otherwise communicate with us through the Site, you may provide:

  • Contact details — your name, email address, phone number, and mailing address.

  • Child and family information — a child’s name, date of birth, and information about developmental concerns, services requested, or referral source that you choose to submit.

  • Provider information — if you are a service coordinator, therapist, or partner organization, your name, agency, professional credentials, and contact details.

  • Message content — any information you include in the body of a form, email, or other communication.

2.2 Newsletter and Mailing List

 

If you sign up to receive updates, newsletters, or announcements, we collect your email address (and any name you provide) so we can send you those communications. You can unsubscribe at any time using the link in our emails or by contacting us.

2.3 Information Collected Automatically (Cookies & Analytics)

 

When you visit the Site, certain information is collected automatically through cookies and similar technologies, including:

  • Your IP address, browser type, device type, and operating system;

  • Pages you visit, links you click, and the dates and times of your visits;

  • The website or source that referred you to our Site.

4. Children’s Privacy

 

Our services are designed for the benefit of young children, but our Site is intended to be used by parents, guardians, caregivers, and professionals — not by children themselves. We do not knowingly allow children to create accounts or submit their own information through the Site.

 

Information about a child is collected only when a parent, guardian, or authorized referral source provides it to us in connection with services. We use this information solely to evaluate eligibility, coordinate care, and provide services, and we protect it with the safeguards described in this Policy and in our HIPAA Notice of Privacy Practices.

 

Consistent with the Children’s Online Privacy Protection Act (COPPA), we do not knowingly collect personal information directly from children under 13 online. If you believe a child has provided us information through the Site without parental consent, please contact us at admin@abckidsny.com and we will delete it.

5. Protected Health Information (HIPAA)

 

As a provider of health-related services, Ability Builders may be a “covered entity” or business associate under the Health Insurance Portability and Accountability Act (HIPAA). Health information that we create, receive, or maintain in connection with providing services — such as evaluations, treatment records, and service notes — is “protected health information” (PHI) and is governed by HIPAA and by our separate Notice of Privacy Practices, not by this website Policy.

Please keep the following in mind:

  • Do not send PHI through unsecured channels. Standard website forms and ordinary email are not secure methods for transmitting detailed health information. Please share only the minimum information needed to start a conversation, and we will follow up using a secure method when appropriate.

  • Secure handling. When we collect health information through the Site, we apply administrative, technical, and physical safeguards intended to protect it consistent with HIPAA requirements.

  • Your HIPAA rights. Your rights regarding your or your child’s PHI — including the right to access, amend, and receive an accounting of disclosures — are described in our Notice of Privacy Practices.

6. How We Share Information

 

We may share information in the following limited circumstances:

  • Service coordination. With service coordinators, evaluators, therapists, partner agencies, and government programs (such as the New York State / NYC Early Intervention Program) as needed to evaluate, authorize, and deliver services.

  • Service providers / vendors. With trusted vendors who perform functions on our behalf — such as website hosting, analytics, email delivery, and IT support — under obligations to protect the information and use it only for those functions. Where required, vendors handling PHI sign business associate agreements.

  • Legal and regulatory. When required by law, regulation, subpoena, court order, audit, or government request, or to protect the safety and rights of children, families, staff, or the public.

  • Business transfers. In connection with a merger, acquisition, reorganization, or similar transaction, subject to applicable law.

  • With your consent. For any other purpose disclosed to you at the time we collect the information or with your authorization.

7. Cookies and Your Choices

 

Most web browsers let you refuse or delete cookies through their settings. If you disable cookies, some parts of the Site may not function properly. You can also opt out of certain analytics tracking using tools provided by the analytics vendor (for example, browser add-ons offered by the analytics provider).

Because there is not yet a common standard for responding to “Do Not Track” browser signals, the Site may not respond to them at this time.

8. Data Retention and Security

 

We retain personal information only as long as necessary to fulfill the purposes described in this Policy, to provide services, and to meet our legal, regulatory, and program record-keeping obligations — which, for clinical and Early Intervention records, may be a period of years as required by law.

We use reasonable administrative, technical, and physical safeguards designed to protect information against unauthorized access, use, alteration, and disclosure. However, no method of transmission over the Internet or electronic storage is completely secure, and we cannot guarantee absolute security.

9. Your Rights and Choices

 

Depending on your location and applicable law, you may have the right to:

  • Request access to the personal information we hold about you;

  • Request that we correct or update inaccurate information;

  • Request deletion of certain information, subject to legal and record-keeping limits;

  • Unsubscribe from marketing or newsletter emails at any time; and

  • Withdraw consent where processing is based on consent.

 

Requests concerning clinical or health records are handled under HIPAA and our Notice of Privacy Practices. To exercise any of these rights, contact us using the information in Section 12.

10. Third-Party Links

 

The Site may contain links to third-party websites or resources that we do not control. This Privacy Policy does not apply to those sites. We encourage you to review the privacy policies of any third-party site you visit.

11. Changes to This Privacy Policy

 

We may update this Privacy Policy from time to time. When we do, we will revise the “Last Updated” date above and post the updated version on the Site. Material changes may be communicated through additional notice where appropriate. Your continued use of the Site after an update means you accept the revised Policy.
